Digital Millennium Copyright Act (DMCA) Policy

ToolsBug.com ("we", "us", "our") respects the intellectual property rights of others and expects our users to do the same. This policy outlines how we handle copyright infringement claims in accordance with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. Section 512).

We will respond expeditiously to claims of copyright infringement reported to our Designated Copyright Agent.

Filing a DMCA Takedown Notice

If you believe that any content on ToolsBug.com (including software listings, descriptions, screenshots, files, or any other material) infringes your copyright, please send a written notification to our Designated Agent that includes all of the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed (or, if multiple copyrighted works are covered by a single notification, a representative list);
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including the exact URL(s) where the material is located;
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

We may share your DMCA notice with the uploader of the allegedly infringing content.

After Receiving a Valid DMCA Notice

Upon receipt of a valid and complete DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material expeditiously
  • Notify the user who posted the material
  • Forward a copy of the notice to the alleged infringer
  • Repeated infringement may result in termination of the user's account.

Counter-Notification

If your content was removed or access was disabled due to a DMCA notice and you believe the removal was a mistake or misidentification, you may file a counter-notification with our Designated Agent containing:

  • Your physical or electronic signature;
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled;
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • Your name, address, and telephone number;
  • A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.

Upon receiving a valid counter-notification, we may forward it to the complaining party. If we do not receive notice within 10-14 business days that the original complainant is seeking a court order, we may restore the material.

Misrepresentation Warning

Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Repeat Infringers

It is our policy, in appropriate circumstances and at our discretion, to disable or terminate the accounts of users who may be repeat infringers.
