Terms and Conditions of Service

1. Preamble

ToolsBug.com, operated by an individual (sole proprietor), with a principal place of business located at:

1771 S Cedar Drive, Apache Junction, AZ, USA

and operating the website available at https://toolsbug.com and/or any other address, application, or location designated by ToolsBug (the "Website", "API", or "ToolsBug"), provides web-based tools and services, including but not limited to web scraping, automation, and data processing services (the "Services").

The present terms and conditions of service (the "General Conditions") govern the contractual relationship between ToolsBug and any natural person aged at least 18 years old with full legal capacity, or any legal entity acting through an authorized representative, who accesses or uses the Services (the "User").

The General Conditions, together with any applicable Acceptable Use Policy (AUP), Privacy Policy, Data Processing Agreement (where applicable), and their exhibits, form the "Agreement."

2. Purpose and Acceptance

The General Conditions govern access to, consultation of, browsing, and use of the Services.

The applicable version of the General Conditions is the one in force at the time the User creates an account and/or uses or subscribes to the Services. Any registration, subscription, payment, or use of the Services constitutes full and unconditional acceptance of the Agreement.

If the User does not agree with these General Conditions, the User must refrain from using the Services and close their account if applicable.

ToolsBug reserves the right to modify the Services and the Agreement at any time. Where required by applicable law, Users will be notified of material changes in advance. Continued use of the Services after the effective date of changes constitutes acceptance of the revised Agreement. The Agreement prevails over any other document unless expressly agreed otherwise in writing.

3. Description of the Services

The Services include, but are not limited to:

• •Access to web-based tools, APIs, and interfaces
• •Creation, execution, and management of scraping, automation, or data-processing configurations
• •Optional access to templates or configurations made available by ToolsBug or other Users
• •Optional professional or custom services, subject to separate written agreement

The Services may include no-code tools as well as advanced configuration options requiring technical knowledge. ToolsBug may modify, update, or discontinue features of the Services at any time.

4. Requirements and Access to Services

Access to the Services requires an internet connection and compatible hardware and software.

The User is responsible for ensuring the accuracy of account information and for maintaining the confidentiality of login credentials. The User is responsible for all activity performed through their account.

ToolsBug may suspend or restrict access in the event of suspected misuse, fraud, or security risks.

5. Availability of the Services

The Services are provided on an "as-is" and "as-available" basis.

ToolsBug does not guarantee uninterrupted availability, error-free operation, or compatibility with all third-party websites or systems. Temporary interruptions may occur for maintenance, security, or technical reasons.

6. Conditions of Use

Users agree to use the Services in compliance with all applicable laws and regulations.

Users shall not, including but not limited to:

• •Use the Services for unlawful, harmful, or deceptive purposes
• •Violate intellectual property, privacy, or data protection laws
• •Scrape or interact with websites in violation of their terms of service
• •Attempt to bypass technical safeguards, rate limits, or security measures
• •Reverse-engineer, resell, or misuse the Services or related technology

The User remains solely responsible for how the Services are used and for any data collected or processed through them.

ToolsBug reserves the right to suspend or terminate access in case of violation of these Conditions.

7. Fees and Payment

Some Services may be offered free of charge, while others require payment.

Where fees apply:

• •Fees are payable in advance unless stated otherwise
• •Fees are non-refundable except where required by applicable consumer protection law
• •Usage limits or credits, if applicable, may expire at the end of a billing period
• •Failure to pay applicable fees may result in suspension or termination of Services.

8. Data and Ownership

The User retains ownership of their data.

ToolsBug may process, store, and analyze data as necessary to provide the Services and may use anonymized and aggregated data for analytics, service improvement, and operational purposes.

The User is responsible for backing up their data. ToolsBug does not guarantee data retention after account termination.

9. Liability

To the maximum extent permitted by applicable law:

• •ToolsBug shall not be liable for indirect, incidental, or consequential damages
• •ToolsBug's total liability shall not exceed the amount paid by the User in the six (6) months preceding the event giving rise to the claim

Nothing in this Agreement limits or excludes liability where such limitation or exclusion is prohibited by applicable consumer protection laws.

10. Governing Law and Jurisdiction

This Agreement is governed by the laws of the State of Arizona, USA, without regard to conflict-of-law principles.

If the User is a consumer, mandatory consumer protection rules of their place of residence may also apply.

Any dispute shall be subject to the jurisdiction of the competent courts in Arizona, USA, unless otherwise required by applicable law.
